Conflicto de competencia suscitado entre el Juzgado Penal del Circuito de Puerto Berrío (Antioquia) y el Juzgado Tercero Promiscuo de Familia de Barrancabermeja.
La Corte reitera que el demandante puede presentar la acción de tutela ante los jueces a prevención para la protección de sus derechos fundamentales.
Precisa, que el peticionario puede elegir entre el lugar donde ocurrió la vulneración, que no necesariamente coincide con el de su domicilio, y aquel en el cual tiene efecto la trasgresión de sus derechos fundamentales.
Teniendo en cuenta la decisión de la tutelante, se dispone remitir el expediente al Juzgado Penal del Circuito de Puerto Berrío, para que asuma de manera inmediata y sin dilaciones el conocimiento del mismo.
